Instituto Nacional de Propiedad Industrial de Chile (INAPI) es designado autoridad internacional ISA/IPEA (PCT)
A fines de 2012 el ámbito nacional de la Propiedad Industrial recibió la grata noticia de la designación del Inapi como Autoridad Internacional de Búsqueda y Examen Preliminar de Patentes (ISA/IPEA) dentro del sistema del Tratado de Cooperación de Patentes (PCT), cuya administración es realizada por la Organización Mundial de la Propiedad Intelectual (OMPI).
Esta importante designación coloca a Inapi dentro de las 18 oficinas de patentes más importantes del mundo. Anteriormente existían 17 oficinas de propiedad industrial con esta calidad, en Australia, Austria, Brasil, Canadá, China, Corea, Egipto, España, Estados Unidos, Federación Rusa, Finlandia, India, Instituto Nórdico de Patentes, Israel, Japón, Oficina Europea de Patentes (EPO) y Suecia.
Con esta designación Inapi se convierte tanto en la segunda autoridad PCT de la región junto a Brasil, como asimismo en el segundo país del mundo de habla hispana en desarrollar informes internacionales de patentabilidad después de la Oficina Española de Patentes.
Ejercer la función de autoridad ISA/IPEA dentro del marco del PCT, significa que Inapi prestará servicios de elaboración de informes de búsquedas y emitirá opiniones escritas en las que se pronunciará sobre si una invención cumple con los requisitos de patentabilidad. Por otro lado, emitirá reportes de exámenes preliminares internacionales, consistentes en opiniones más acabadas respecto del cumplimiento de los requisitos de patentabilidad de una solicitud de patente PCT.
Desde una perspectiva más general, esta designación implica un reconocimiento a la labor realizada por Inapi y significa una gran oportunidad de tener mayor participación e influencia en la toma de decisiones dentro del sistema de patentamiento a nivel global, lo que esperamos redunde en un real incentivo para el uso del sistema PCT en América Latina y que a nivel país convierta a Chile en un polo regional de emprendimiento e innovación.
De acuerdo con los compromisos contraídos por nuestro país con la Unión PCT, esta función de autoridad ISA/IPEA, comenzará a implementarse aproximadamente a partir del año 2014, debido a los ajustes y requerimientos que Inapi deberá implementar para un correcto funcionamiento de este nuevo sistema.

National Institute of Industrial Property of Chile (INAPI) is designated international ISA/IPEA (PCT) authority
In late 2012 the Chilean Industrial Property community received the encouraging news that INAPI had been designated International Searching Authority of Patents (ISA) and International Preliminary Examining Authority of Patents (IPEA) within the system created by the Patent Cooperation Treaty (PCT), whose administration is entrusted to the World Intellectual Property Association (WIPO).
This significant appointment places INAPI among the 18 most important patent offices in the world. Up until this designation there were 17 industrial property offices worldwide with this distinction, in Australia, Austria, Brazil, Canada, China, Korea, Egypt, Spain, United States of America, Russian Federation, Finland, India, Nordic Patent Institute, Israel, Japan, European Patent Office (EPO) and Sweden.
With this designation INAPI becomes the second regional PCT authority after Brazil and the second Spanish speaking country in the world responsible for the preparation of international patentability reports, after the Spanish Patent Office.
INAPI's exercise of its ISA/IPEA authority within the framework provided by the PCT means that INAPI will provide search reporting services and will issue written opinions deciding if an invention meets patentability requisites. In addition, INAPI will release international preliminary examination reports, consisting of more elaborate opinions on a PCT patent application compliance with patentability requisites.
From a more general perspective, this appointment involves a recognition of the work carried out by INAPI and provides a great opportunity for an increasing INAPI participation and influence in the decision making process within the global patent processing system, which we expect will result in a real incentive for the use of the PCT system in Latin America. At the country level, this may help Chile become a regional entrepreneurship and innovation center.
In agreement with the commitments undertaken by our country with the PCT Union, the implementation of this ISA/IPEA authority will begin in the year 2014, considering the developments and capabilities that INAPI must put in place towards a proper operation of this new system.
