INAPI publica directrices sobre el procedimiento de registro de patentes

A fines del mes de noviembre INAPI publicó un documento denominado, "Directrices de Examen y Procedimiento de Registro de Patentes", documento que tiene por objeto hacer públicas y armonizar las prácticas internas que el Subdepartamento Jurídico de Patentes de INAPI, aplica en la tramitación de solicitudes de patentes de invención, modelos de utilidad, diseños industriales y dibujos industriales.

Este documento supone una sistematización de los distintos lineamientos sobre las prácticas y normas legales especiales, que rigen la tramitación y concesión de esta categoría de privilegios industriales, encaminada a lograr que el procedimiento de registro se agilice, mientras se otorga certeza jurídica a los inventores, sus representantes y público en general.

Otro mérito de este documento radica en el hecho de ser fruto de una discusión profunda y abierta al público, en la que todos los actores involucrados y usuarios habituales del sistema de registro de estos derechos industriales ante INAPI, pudieron hacer presentes sus comentarios y críticas respecto del texto, siendo varias de éstas acogidas por el Instituto en la versión final de las directrices.

Por último, es preciso señalar que en términos generales, este documento aborda la tramitación de las patentes de invención, modelos de utilidad y diseños y dibujos industriales, desde dos perspectivas: la primera, referida a los aspectos prácticos y adjetivos en la presentación y procedimiento de tramitación, incluyendo el examen de forma y el procedimiento contencioso, mientras que la segunda es atingente al examen de fondo de las solicitudes, destacando cuáles son los criterios aplicables en materia de requisitos sustantivos de patentabilidad y demás requerimientos que establece la Ley de Propiedad Industrial, como su Reglamento.

The Chilean Patent Office publishes its guidelines on the registration procedure of patent applications.

In November 2013, the Chilean Patent Office (INAPI, by its acronym in Spanish), published a document entitled "Guidelines on the Examination and Registration Procedure of Patents Applications", with the aim of making even more transparent the internal practices of the INAPI?s Legal Affairs Department, applied to the processing of patent, utility model, industrial design and industrial drawing applications.

This document embodies a systematization of several parameters on the practices and especial regulations which govern the processing and granting of this category of industrial rights, aimed to enhance and expedite the registration procedure, while legal certainty is afforded to the inventors, their legal representatives and people in general.

One of the merits of this document lies in the fact that it is the result of a deep and public discussion, wherein all the stakeholders and users of the registration system of these kind of Rights before INAPI, were able to present their comments and opinions, and most of them were considered by INAPI and finally included in the final version of these guidelines.

Finally, it is important to mention that in general terms; this document addresses the processing of patent, utility model, industrial design and industrial drawing applications from two perspectives: the first one, referred to the practical and adjective aspects of the filing and processing of the applications, including the examination of formal requirements and the contentious procedures; and the second one related to the patentability examination process, involving the necessary review of the regulations, their legal interpretation by INAPI and their applicability in the daily practice of this public institution.
