Con fecha 5 de marzo de 2010, el Servicio de Impuestos Internos dictó la Circular No. 19 y publicó una noticia (ambos documentos disponibles en www.sii.cl), para orientar a los contribuyentes acerca del tratamiento tributario aplicable a las donaciones en favor de los damnificado por el terremoto.

El presente comunicado está destinado a nuestros clientes y amigos y tiene por objeto difundir el tratamiento tributario aplicable a las donaciones efectuadas en favor de los damnificados por el terremoto y sistematizar alguna información complementaria de tipo general relativa al tema, en un formato de preguntas y respuestas.

¿En qué consiste el Beneficio?

En el caso de donaciones efectuadas al amparo del D.L. No. 45, de 1973 y normas complementarias, el monto de la donación se puede deducir como un gasto en la determinación de la renta afecta a impuesto. Es importante destacar que el beneficio no consiste en un crédito o rebaja deducible directamente del impuesto a la renta, sino que la rebaja se deduce de la renta o base imponible, motivo por el cual su efecto es de menor incidencia que el de un crédito contra el impuesto.

Además, la Circular del SII No. 19, de 2010, ha confirmado que en este caso no resulta aplicable el impuesto a los gastos no deducibles establecido en el Art. 21 de la Ley sobre Impuesto a la Renta (LIR).

¿Quiénes pueden ser Donantes?

Si bien todos los contribuyentes pueden ser donantes, el beneficio tributario sólo favorece a aquellos contribuyentes que obtengan rentas de Primera o Segunda Categoría, sobre las que tributen por su renta efectiva. También debería favorecer a ciertos contribuyentes del Impuesto Adicional.

¿Es necesario realizar el trámite de insinuación (autorización que debe solicitarse al juez competente)?

No. Estas donaciones están liberadas del trámite de insinuación contemplado en los Arts. 1401 y ss. del Código Civil y 889 y ss. del Código de Procedimiento Civil (Art. 2 del D.L. No. 45, de 1973).

¿En qué pueden consistir las donaciones?

En este caso, tanto las donaciones de dinero, como aquellas que consistan en especies, bienes o mercaderías, dan derecho al beneficio.

¿Existe algún límite en cuanto al monto de las donaciones?

La Circular del SII No. 19, de 2010, ha señalado que no se aplicará el límite general de 5% que afecta a las demás donaciones y que el monto de esta donación tampoco se considera para el cálculo de tal límite respecto de otras donaciones, lo cual representa un cambio en el criterio del organismo fiscalizador.

La referida Circular ha aclarado que las empresas con pérdidas también gozan del beneficio, pudiendo incluso aumentar su pérdida.

¿Cómo se deben acreditar las donaciones?

El SII ha señalado que para efectos de acreditar las donaciones en eventuales procesos de fiscalización a donantes que invoquen el beneficio, serán aceptables aquellos medios de prueba documentales que sean usuales y corrientes, como depósitos o transferencias bancarias a cuentas acreditadas, facturas o boletas de compra, guías de despacho, contratos de transporte o despacho, contabilidad fidedigna, etc.

Sin embargo, recomendamos actuar con diligencia, a fin de poder acreditar fehacientemente las donaciones en eventuales procesos de fiscalización. Así por ejemplo, en el caso de donaciones al Estado, al Ministerio del Interior, a la Onemi o a otras autoridades que se designen, deberían emitir y entregar un comprobante o certificado que indique el nombre y RUT del donante, la naturaleza y valor de la donación y la fecha de la donación, especificando que se trata de una donación para la recuperación del país a raíz del terremoto. Igual certificado debería obtenerse en el caso de donaciones a entidades de reconocida experiencia en la recepción de recursos, tales como Fundación Teletón, Cruz Roja, Hogar de Cristo, Un Techo para Chile, entre otras. En los demás casos, es recomendable emplear especial diligencia para obtener y conservar los documentos que permitan acreditar fehacientemente la efectividad de la donación, su fecha y monto.

En todo caso, se hace presente que el donatario debe efectuar la Declaración Jurada 1832 en marzo del año siguiente a la donación (el día exacto de vencimiento varía de un año a otro), dejando constancia que no ha realizado ninguna contraprestación en favor del donante.

¿Se genera algún impuesto para el Donatario o Beneficiario de la donación?

Los donatarios o beneficiario no están afectos a impuesto a la renta, ni a impuesto a las herencias y donaciones por los dineros o bienes recibidos (Art. 17 No. 9 de la LIR, Art. 1 del D.L. No. 45 de 1973 y Art. 18 No 6 de la Ley de Impuesto a las Herencias y Donaciones).

¿Se aplica I.V.A. a aquellos Vendedores o Prestadores de Servicios que efectúen donaciones consistentes en bienes?

No. En la medida que las donaciones no persigan fines promocionales o de propaganda, no están afectas a I.V.A. (Art. 8, letra d), de la Ley de Impuesto a las Ventas y Servicios y 3 de su Reglamento).

¿Qué otras consideraciones se deben tener presentes?

1) Cada contribuyente puede necesitar asesoría tributaria, en función de sus propias circunstancias.

2) El Art. 97 No. 24 del Código Tributario establece una figura penal y sanciona a los contribuyentes que, dolosamente y en forma reiterada, reciban de las instituciones a las cuales efectúen donaciones, contraprestaciones directas o indirectas o en beneficio de sus empleados, directores o parientes, efectuadas en el año anterior a la donación o con posterioridad a ésta, en tanto la donación no se hubiere usado íntegramente por la donataria o simulen una donación, en ambos casos, de aquellas que otorgan algún tipo de beneficio tributario, y sanciona también otras formas de uso inadecuado o abuso de estos beneficios.

On March 5, 2010, the [Chilean] Internal Revenue Service (Servicio de Impuestos Internos, SII) issued Circular Letter No. 19 and published other news (both documents available in www.sii.cl), guiding taxpayers on the tax treatment applicable to donations made in favor of people affected by the earthquake.

This communication is intended for our clients and friends to inform them about the tax treatment applicable to donations made in favor of people hurt by the earthquake and in order to systematize some general complementary information on the matter, in a question and answer format.

What is the nature of the [tax] Benefit?

In the case of donations made under Statutory Decree (D.L.) No. 45, of 1973, and its complementary norms, the donation amount may be deducted as an expense when calculating taxable earnings. It is important to underline that this benefit does not consist of a credit or reduction directly deductible from the income tax, but the [allowed] deduction lowers taxable earnings, this being the reason why its effect is less than the effect of a credit against the tax.

In addition, the SII's Circular Letter No. 19, of 2010, has confirmed that in this case it is not pertinent to apply the tax on nondeductible expenses stipulated in Article 21 of the Income Tax Law (Ley sobre Impuesto a la Renta, LIR).

Who may be Donors?

Although all taxpayers may be donors, the tax benefit only favors taxpayers who receive Corporate or Professional (Primera o Segunda Categoría) incomes and pay taxes on their actual earnings. It may also favor certain taxpayers subject to the Additional Income Tax.

Is it necessary to conduct authentication or certification proceedings for the donation (an authorization that must be requested from the competent judge)?

No. These donations are exempt from the authentication or certification proceedings provided in Articles 1401 et seq. in the Civil Code and Articles 889 et seq. in the Civil Procedure Code (Article 2 in D.L. No. 45, of 1973).

What can the donations consist of?

In this case, both donations in cash and those consisting of goods, in kind or merchandise, entitle donors to the benefit.

Is there any limitation on the donations' amount?

SII's Circular Letter No. 19, of 2010, indicates that the general 5% limit applicable to the other donations will not apply and that the amount of this donation will not be considered in the calculation of said limit in respect of other donations, which evidences a change in this supervisory agency's criterion.

The above-mentioned Circular Letter also makes clear that companies with losses are also favored with the benefit and may even increase their losses.

How must donations be certified?

The SII indicated that in order to certify the donations in possible future tax audits to donors who invoke the benefit, it will accept the customary and usual documentary evidence such as bank deposits or transfers to valid accounts, purchase invoices or vouchers, waybills, transport or dispatch contracts, reliable accounting records, etc.

However, we recommend acting diligently, in order to be in a position to irrefutably certify the donations in possible future tax audits. For example, in case of donations to the State, the Ministry of the Interior, the National Emergency Office (Oficina Nacional de Emergencia, Onemi) or other appointed authorities, they should issue and deliver a voucher or certificate indicating the donor's name and Tax ID Number (Rol Único Tributario, RUT), the donation's nature, value and date, indicating that it is intended for the country's recovery from the earthquake. The same certificate should be obtained in the case of donations made to widely recognized and experienced entities that receive this kind of resources, such as the Fundación Teletón, the Red Cross, the Hogar de Cristo, Un Techo para Chile, among others. In other cases, it is advisable to be particularly diligent in order to obtain and keep the documents that will unquestionably certify the donation, its date and amount.

In any case, it must be remembered that the donor must file Sworn Statement 1832 in March of the year following the donation (the exact due date of this statement varies every year), stating that there has been no valuable consideration in the donor's benefit.

Does any tax accrue for the Donee or Beneficiary of the donation?

Donees or beneficiaries are not subject to income tax, nor to inheritance and donation taxes on the money sums or goods received (Article 17 No. 9 in the LIR, Article 1 in D.L. No. 45, of 1973 and Article 18 No 6 in the Inheritances and Donations Tax Law (Ley de Impuesto a las Herencias y Donaciones).

Does the Value Added Tax (Impuesto al Valor Agregado, I.V.A.) apply to Sellers or Service Providers who make donations in kind?

No. To the extent that donations do not seek promotional or advertising aims, they are not subject to I.V.A. (Article 8, letter d, in the Sales and Services Tax Law (Ley de Impuesto a las Ventas y Servicios) and Article 3 in its regulations).

Are there other considerations to be kept in mind?

1) Every taxpayer may need tax advice, depending on his or her specific circumstances.

2) Article 97 No. 24 in the Tax Code (Código Tributario) defines a criminal conduct and penalizes taxpayers who fraudfully and repeatedly receive from the institutions they donate to, direct or indirect valuable considerations or benefits for their employees, directors or relatives, during the year preceding the donation or after the same, where the donation was not completely used by the donee. It also penalizes taxpayers who simulate a donation and, in both cases, whenever they seek a tax benefit in these circumstances. It also punishes other improper uses or abuses of these benefits.
