The group is usually involved in high-profile projects and handles a broad spectrum of both front-end and contentious mandates in sectors such as, commercial buildings, housing, mining, energy and infrastructure.

The Projects group offers unrivalled scale and reach with end-to-end capability. Its partners are highly regarded for its deep understanding of the construction industry (problems, processes, concepts, language as well as the challenges), and its lawyers’ expertise – both legal and in-the-field – provides a unique perspective to guide and assist clients through the project life cycle, with specialists in corporate, construction, financing, real estate, IP, environmental, labour, tax and litigation.

The group has significant presence in the market and is currently advising owners in some of the key projects in Chile, as well as counsel for the most renowned contractors.

Some of our previous projects include: power plants (renewal and non-renewal energy), highways, roads and tunnels, processing plants, mining facilities, mine tunneling, water pipelines, water and waste treatment facilities, ports, ocean outfall pipelines, bridges, dams, airports, underground parking, professional sports stadiums and arenas, hospitals, churches, hotels, schools, residential and commercial buildings.

Our lawyers’ attend high profile meetings and write for specialized and exclusive publications. Our relationships with industry associations, industry leaders and regulators provide us with deep insight into the issues that matter most to our clients. In this aspect, our partner Juan Pablo Halpern is co-chair of an expert committee of Construye2025, a governmental initiative created to boost productivity in the construction sector.

This department usually team up with other experts (e.g. engineers), as is a standard market practice for complex construction projects to work alongside multidisciplinary experts.

Contract drafting and negotiation

In many cases, owners, engineers, architects, contractors and subcontractors alike develop their own contract forms with provisions and language not typically encountered. In other instances, unique features of some projects require custom contracts or significant modification to industry forms.

Our expertise provides a unique perspective for our counsel and advice as we guide and assist clients through the process of drafting and negotiating contracts. We have also developed custom form contracts. These custom contracts are adaptable to a variety of projects and circumstances.

Strategic advice during construction

Because the action or inaction of owners and contractors in response to project events dictate whether an issue will evolve into a dispute, we encourage our clients to seek out early counsel and advice.

Our involvement in brainstorming solutions and assisting in the development of ideas to address pressing issues early-on has resulted in claim and dispute avoidance. When a claim is later necessary, our advice during construction can streamline the claims process to maximize results.

Claims drafting and coordination

We have extensive hands-on experience drafting and presenting formal claims to public and private owners. We developed an ad-hoc claims presentation method, which results in a concise and logical illustration of the client’s entitlement and damages.

Our litigation attorneys have extensive experience in arbitrating and litigating complex disputes with an outstanding track record.

Representative Experience

  • Mining sector – Advising a mining company on drafting a series of contracts forms (including EPC) to support their projects and operation in Chile.
  • Infrastructure sector – Strategic advice to a port concessionary in relation to the construction of a US$ 450 million port in San Antonio, including non-contention work related to claims presented by the EPC contractor.
  • Commercial sector – Counsel to a real estate developer on all construction aspects of a US$ 240 million office building complex project in Santiago, including drafting and negotiating the US$ 100 million lump sum contract for the structural works with the main contractor of the project.
  • Disputes – Advising a Chilean mining company in a claim against their EPCM contractor for gross negligence. This was a multi-million dollar claim where he acted in conjunction with international co-counsel.

Projects

We provide advice in real estate law matters for a broad range of clients, including developers, investors, financiers and company whose business includes acquisition, development, ownership of immovable property, and operations and merger and acquisition operations of commercial real estate hotels, sale of office buildings, industrial properties, housing real estate projects and shopping centers. We have participated in business loan operations, relevant real estate projects.

Representative experience:

  • Advisor for the construction of a complex of three buildings for offices and commerce in Santiago, Chile.
  • Advice to the developer in the planning, development and execution of a project of 370 houses in Quillota, Chile.
  • Counsel to the developer for the construction of the 10-story unit in La Reina, Chile.
  • Advising the contractor in the negotiation of a contract for the expansion and remodeling of the office unit in the district of Santiago, Chile.
