Chilean Patent Office grants first patent application that inaugurated PPH in Chile

Successful activation of the PPH pilot program between IMPI and INAPI was key to granting a patent of invention in Chile in less than a year.

On March 1st, 2017, the Chilean Patent Office notified the allowance to final registration the first patent application that in Chile inaugurated the PPH Pilot Program on December 15, 2016.

Thanks to the Pacific Alliance’s PPH Pilot Program, Mr. Sergio Grijalva became the first Mexican inventor who obtained a patent in Chile in less than a year, counted from the filing date of his patent application at INAPI on March 3rd, 2016.

Once the PPH was requested before Inapi, by Alessandri,  Mr. Grijalva’s legal representative in Chile; the substantive examination process was carried out in less than 3 months, resulting in the granting of the patent within an extraordinary term of less than 12 months, in comparison to the average prosecution time of a non-contentious patent application in Chile, that can take an average of 36 months.

This important collaborative effort of the Colombian, Mexican, Peruvian and Chilean Patent Offices to speed up the examination of patent applications in the region; has demonstrated how this particular PPH pilot program can lead to an effective and synergic integration of the patent systems in the Latin American region, so that precisely by using this kind of juridical tools, inventors/individual petitioners, educational and business entities applying for a patent, law firms and the patent offices themselves; can take advantage of simplified processes and become even more connected and aware of the advances in the prosecution of their common patent applications, to have a more integrated view of the patent portfolio management and look for a timely and cost-efficient way to protect inventions.

In the Latin American region, the government funding for innovative entrepreneurs has been increasing over the last few years, and several of Alessandri’s clients have been directly benefited from that. It is also true that this is not the only important variable for fortifying the region and make it a true pole of competitive innovation, nonetheless, at least in the case of Chile, since 2012 there is also a law to encourage innovation through taxation discounts, that -from our perspective- together with the government financing of innovative projects; have created an increasingly healthy R&D ecosystem in the country.
